1. Who we are and what these terms cover
PorchIQ is made by FrontPorchIQ LLC, a Michigan limited liability company at 207 E. Grand River Ave, Suite 1A, Howell, MI 48843 ("PorchIQ", "we", "us"). These Terms of Service ("Terms") cover the PorchIQ software you install at your property (the desktop, mobile, Home Assistant add-on and Docker versions), the porchiq.com website, your PorchIQ account, remote access, support, and any subscription (together, the "Service").
By creating an account, installing, or using PorchIQ, you agree to these Terms and to our Privacy Policy. If you use PorchIQ for a business or for someone else's property, you agree on their behalf and confirm you are authorized to do so. You must be at least 18 to create an account. Other household members may use PorchIQ under your account, and you are responsible for their use.
2. License to use the software
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use PorchIQ at the properties registered to your account, for your household or your own business, for as long as you follow these Terms and, for paid features, keep your subscription active.
You may not: copy or redistribute the software except as needed to install and back it up; sell, rent, or sublicense it; reverse engineer or bypass license checks, feature limits, or security, except where the law expressly allows; remove notices; or use PorchIQ to build a competing product.
PorchIQ includes open-source software, which is licensed to you under its own license, listed in the app and on porchiq.com/legal. Nothing in these Terms limits your rights under those licenses.
We own PorchIQ, its brand, and all improvements. If you send us ideas or feedback, we may use them without owing you anything.
3. Plans, trials, billing, and cancellation
PorchIQ offers Basic, Platinum and Enterprise plans as described on porchiq.com/pricing. New installs get a 14-day free Platinum trial with no card required.
Paid plans renew automatically each month or year until you cancel. Payments are processed by Stripe, or by Apple or Google if you subscribe in their app stores, and are subject to their terms. Prices exclude any applicable taxes, which we add where required.
You can cancel at any time in your account or app store settings. Cancellation takes effect at the end of the current billing period. If you subscribed through Apple or Google, their refund rules apply. For subscriptions bought from us: monthly charges are not refunded; a yearly charge is refundable in full if you ask within 14 days of the charge; after that we do not give partial refunds, except where required by law or at our discretion.
When a subscription ends, your property drops to Basic mode rather than stopping. Dashboards, controls, live cameras, notifications and safety confirmations keep working, and automations saved in Home Assistant keep running. Paid features pause.
We may change prices with at least 30 days' notice by email or in the app. A change applies at your next renewal after the notice period, and you can cancel before it does.
4. Important safety limits
PorchIQ is a convenience and information tool. It is NOT a professional alarm-monitoring service, a life-safety system, a fire, carbon monoxide, flood, or medical alert system, or a substitute for calling 911. Do not rely on it as your only way to protect people, animals, or property.
PorchIQ depends on things outside our control, including your internet and power, your computer, Home Assistant, device makers' apps and cloud services, and wireless signals. Notifications, automations, locks, garage doors, gates, cameras, and alarms may be delayed, missed, or act unexpectedly.
AI features (such as camera descriptions, picture search, plate reading, the assistants, and the automation writer) can be wrong. Check anything important yourself, and review automations before turning them on, especially ones that unlock doors, open garage doors or gates, or disarm alarms.
Professional monitoring, if we offer it, is provided by a separate monitoring company under its own terms.
5. Cameras, recording, and the people around you
You are responsible for how you use cameras, microphones, plate reading, and presence detection, including: following the recording, privacy, and notice laws where your property is; posting signs where required; not pointing cameras where people expect privacy (such as bathrooms, bedrooms of others, or neighbors' homes); getting consent where the law requires it; and telling guests, renters, workers, and household members that PorchIQ is in use. Audio recording is off by default; turn it on only where it is lawful.
6. Your account and acceptable use
Keep your sign-in methods secure, and tell us promptly at [email protected] if you think someone else has accessed your account. You are responsible for activity under your account.
Do not use PorchIQ to: watch, track, or control anyone without legal right; break any law; interfere with the Service or other users; probe or attack our systems; or post unlawful, abusive, or infringing content in the community forum. We may remove community content and suspend accounts that break these rules.
7. Third-party devices and services
PorchIQ connects to products and services we do not control, such as Home Assistant, device makers' clouds, vehicle makers, Stripe, Apple, Google, Cloudflare, and Twilio. Your use of them is governed by their terms. When you connect an account, you allow PorchIQ to act on it at your direction. A third party may change or end its service at any time, and an integration may stop working as a result; that is not a breach of these Terms.
8. Your data
Your household data belongs to you. Most of it stays on the computer running PorchIQ at your property, as described in our Privacy Policy. You are responsible for keeping that computer secure and backed up; PorchIQ includes backup tools to help. You give us permission to process the limited data that reaches us only to run, secure, support, and improve the Service.
9. Updates and changes
We may update the software to fix problems, improve security, add or remove features, or keep up with third parties. We may change these Terms; if a change is material we will tell you at least 30 days ahead by email or in the app. Continuing to use PorchIQ after the change takes effect means you accept it.
10. Ending the Service
You may stop using PorchIQ and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if required by law, or if we stop offering the Service (in which case we will give reasonable notice and refund any prepaid unused time). Sections 2 (ownership), 4, 5, 11, 12, 13, and 14 survive.
11. Disclaimer of warranties
EXCEPT AS STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEVICE, NOTIFICATION, OR AI RESULT WILL WORK OR BE ACCURATE.
12. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROPERTY DAMAGE, THEFT, OR PERSONAL INJURY ARISING FROM A DEVICE, AUTOMATION, NOTIFICATION, OR AI RESULT FAILING OR ACTING UNEXPECTEDLY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100. Some places do not allow these limits, so they may not fully apply to you.
13. Indemnity
You will defend and hold us harmless from claims by others arising from your use of cameras, recording, or monitoring in violation of law or of these Terms, or from your breach of Section 6.
14. Disputes and governing law
These Terms are governed by Michigan law, without regard to conflict-of-law rules. Before filing a claim, please email [email protected] so we can try to resolve it informally within 30 days. Any claim that is not resolved must be brought in the state or federal courts located in Livingston County, Michigan, or, for claims within its limits, small claims court where you live.
15. General
These Terms, the Privacy Policy, and any plan details you accept are the whole agreement between us about the Service. If a part is unenforceable, the rest stays in effect. Not enforcing a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them with our business. Apple and Google are not parties to these Terms and have no responsibility for the app, but are third-party beneficiaries of the license in Section 2 for apps downloaded from their stores.
